Terms of Service

1. Agreement to Terms

By accessing or using AdPilotAgent ("Service"), operated by Dominik Weber, Jöllenbecker Str. 143, 33613 Bielefeld, Germany ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

AdPilotAgent is an AI-powered advertising automation platform that:

• Analyzes websites to generate advertising strategies
• Creates and manages ad campaigns on Google Ads and Meta Ads
• Generates ad copy, images, and videos using artificial intelligence
• Optimizes campaign performance autonomously
• Provides performance reporting and analytics

3. Account Registration

• You must be at least 18 years old to use the Service
• You must provide accurate and complete registration information
• You are responsible for maintaining the security of your account credentials
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account

4. Third-Party Platform Connections

By connecting your Google Ads, Meta Ads, or Google Tag Manager accounts to AdPilotAgent, you:

• Authorize us to access and manage your advertising accounts on your behalf
• Confirm that you have the authority to grant such access
• Acknowledge that we will create, modify, pause, and optimize campaigns and ads in your accounts
• Understand that advertising costs are billed directly by Google and Meta to your advertising accounts, not by AdPilotAgent

You may revoke platform access at any time through the Settings page. Revoking access will stop AdPilotAgent from managing your campaigns but will not automatically pause or delete existing campaigns on those platforms.

5. AI-Generated Content

• The Service uses artificial intelligence to generate ad copy, images, videos, and marketing strategies
• AI-generated content is provided as suggestions and may require review before publication
• We do not guarantee that AI-generated content will be free of errors, suitable for your specific needs, or compliant with all advertising platform policies
• You are ultimately responsible for all content published through your advertising accounts
• AI-generated images and videos are created for your use within the Service and may not be redistributed separately

6. Autonomous Campaign Management

AdPilotAgent may perform the following actions automatically on your behalf:

• Pause underperforming campaigns or ads
• Replace ads with new AI-generated alternatives
• Pause or add keywords for search campaigns
• Create and evaluate A/B tests
• Pause campaigns when monthly budget limits are reached
• Reactivate budget-paused campaigns at the start of a new month

AdPilotAgent will never increase your daily or monthly budget limits. Budget amounts are always controlled by you.

7. Fees and Payment

• Service fees are as described on our pricing page
• Advertising spend (the money spent on Google Ads and Meta Ads) is separate from and in addition to AdPilotAgent service fees
• Advertising spend is billed directly by Google and Meta
• We are not responsible for overcharges or billing issues with third-party advertising platforms

8. Limitation of Liability

• The Service is provided "as is" without warranties of any kind
• We do not guarantee specific advertising results, return on ad spend (ROAS), or conversion rates
• We are not liable for losses resulting from AI-generated content, automated campaign decisions, or platform policy violations
• Our total liability shall not exceed the fees paid by you in the 12 months preceding the claim
• We are not liable for any actions taken by Google, Meta, or other third-party platforms regarding your accounts or ads

9. Prohibited Uses

You may not use the Service to:

• Promote illegal products, services, or activities
• Create misleading or deceptive advertisements
• Violate the advertising policies of Google, Meta, or other connected platforms
• Infringe on intellectual property rights of others
• Attempt to reverse-engineer, decompile, or extract the source code of the Service
• Use the Service to harm, harass, or discriminate against any person or group

10. Termination

• You may terminate your account at any time through the Settings page
• We may suspend or terminate your account for violations of these Terms
• Upon termination, your data will be handled as described in our Privacy Policy
• Termination does not automatically pause or delete campaigns running on third-party platforms

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the Federal Republic of Germany. The place of jurisdiction is Bielefeld, Germany, to the extent permitted by law.

12. Dispute Resolution

The European Commission provides an online dispute resolution platform at ec.europa.eu/consumers/odr. We are not willing or obliged to participate in dispute resolution proceedings before a consumer arbitration board.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes by posting the updated Terms on this page and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the new Terms.
